Adult Misdemeanor

  1. There are no criminal charges pending against you in any court of this or another state, or in any federal court;
  2. You have not been convicted of a new crime in this state or another state, or any federal court since the date you were sentenced on the crime you are trying to have vacated;
  3. You have never had any other conviction vacated;
  4. You are not currently, and have not within the past 5 years, been restrained by any no-contact, anti-harassment, protection, or civil restraining order that prohibits you from contacting another person;
  5. The conviction you are trying to vacate is not a DUI/DWI, a sex offense, an obscenity or pornography offense, or a crime involving sexual exploitation of children;

If the crime you want to vacate did not involve Domestic Violence, three years must have passed since you completed the terms of your original sentence. If Domestic Violence was involved, you must wait five years before moving to vacate the conviction.
