Motions to Vacate

If you meet these criteria, there is a good chance that your conviction will be vacated by the Court. Once vacated, the prior conviction will not be included in your criminal history. You may legally tell an employer or other interested party that you have never been convicted of a crime.

Just because your conviction is vacated does not automatically restore your right to possess firearms. However, if you are eligible for a vacation of your conviction, you are probably also eligible for your firearm rights to be restored. Both the Motion to Vacate and the Motion to Restore Firearm Rights can be brought at the same time.
