WHAT IS DOMESTIC VIOLENCE?

There is no doubt that what we call "Domestic Violence" is a serious social problem in our society. Family arguments may lead to physical violence and, if left unchecked, may escalate over time into situations that result in serious injuries or death. Not long ago, the Tacoma Chief of Police shot and killed his wife and himself after years of escalating Domestic Violence and abuse ignored by local authorities. It can happen in any family. There is much to be said for early intervention in these serious situations, and in our society, we call upon the Court System to fill that role.

The legal definition of "Domestic Violence" in Washington is:

  1. Physical harm, bodily injury, assault, or the infliction of fear of imminent physical harm, bodily injury or assault, between family or household members; OR
  2. Sexual assault of one family or household member by another; OR
  3. Stalking of one family or household member by another family or household member.

Over the years, our society's attitude about domestic violence has changed. Police may no longer respond to a Domestic dispute call, calm the parties down, and leave when the situation seems stabilized, as they could when I was a kid. Police are now required to make an arrest of one of the parties no matter what the circumstances may be. If the police cannot determine who the "aggressor" is, both--or all parties allegedly involved--will be arrested.
