Recent Successful Firearm Defenses

1. A man with a long forgotten juvenile conviction for car theft is out camping with some friends. One of the friends brings a rifle for safety. Park Rangers stop the group and cite them for being in a restricted area in a Federal Park; client happens to be carrying the rifle at the time.

Rangers perform a warrant check and discover that client has old but still valid felony conviction as a juvenile. He is arrested and charged with Unlawful Possession of a Firearm Second Degree.

Result: Not Guilty. Client was only carrying the rifle for its true owner for a matter of moments. His possession was therefore only transitory. (Note: Just because a conviction is old or was committed while a juvenile doesn't mean it just "goes away"; see Clearing My Record).

2. Client's ex-girlfriend still has a key to his home. She appears unannounced, enters his home, and begins to argue violently with the client. She has a history of assaultive behavior. He picks up his hunting rifle and uses it to "herd" her out the door by force, occasionally pointing the barrel at her. She calls police and he is charged with Unlawful Display of a Firearm.

Result: Case Dismissed. Judge ruled pretrial that the client had a statutory right to brandish a firearm in his own home, even though she still had a key to the residence.

3. Client is charged with Assault Second Degree for pointing his legally carried handgun at three antagonistic men who surrounded and threatened him at a party at a private residence. All three men fled, one called 911.

Result: Not Guilty. The jury found that the client had acted in self-defense. He was outnumbered 3 to 1, the three men initiated the confrontation, were overtly hostile, physically large, and the client feared for his own safety.
